Production of Didactic Materials in Distance Education: Tensions Between Teacher Authorship, Copyright, and the Use of Artificial Intelligence

Abstract

This article investigates faculty practices and perceptions regarding copyright and the use of Artificial Intelligence (AI) in the production of didactic materials for Distance Education (DE) courses at public universities, with emphasis on the experience of the Virtual University of the State of São Paulo (UNIVESP). The choice of this institution as the research setting is justified by its relevance within the contemporary Distance Education landscape, marked by the significant expansion of online higher education in Brazil over the last decade, as well as by UNIVESP’s strategic role in broadening access to public higher education through large-scale educational initiatives. Using a qualitative and exploratory approach, the study combined literature review, documentary analysis of institutional calls for applications issued between 2018 and 2024, and semi-structured interviews with content-development professors affiliated with the institution. The findings reveal institutional gaps regarding the regulation of AI use and the clarification of copyright guidelines, despite advances in the requirement for original authorship and the adoption of copyright assignment agreements. The interviews also revealed different levels of AI appropriation among faculty members, ranging from resistance and cautious use to strategic and critical experimentation, in addition to ethical concerns related to authorship and potential copyright violations. Finally, the study highlights the need for clearer institutional policies, continuous faculty training, and greater recognition of intellectual authorship in order to strengthen a digital educational culture grounded in legality, ethics, and pedagogical innovation.
